I suspect there's more to it than this. For example, people continue to drink and drive, and rather than raise the legal BAC limit, it keeps getting lowered, as penalties get stiffer.

I'm happy you can be happy as long as people don't smoke in areas that would be a nuisance to others. You have smoking areas, go smoke there.
It's illegal in my country yet people still smoke in their apartments with open windows so everyone in the complex has to deal with the horrible smell whenever that happens.
