The actual disagreement is narrower than he frames it: US doctrine draws the line at incitement/direct threats, French/EU doctrine extends it to "insulting" and vaguely defined harms to a "common framework," which is precisely the part that gives governments discretion to criminalize dissent. The slippery part isn't the principle, it's who defines "respect for the common space."
