In our not-Ancapistan world, the state manages property on behalf of the nation, and it is the nation's property that is being trespassed upon.
I do agree this is a suboptimal arrangement. But given that their presence on said land also comes with additional costs that are shared across the nation's tax base, it is the situation we have.
