Nah... they know better than to actually pursue individuals who will fight in court. They just pressure companies who don't want to spend any more than they have to. If there's no company, there's no enforcement because enforcement is too costly this way (distributed and exponential, the more individuals you charge, the harder it is to prosecute all of them in the same fixed number of days and courts)
They might charge one person with his head stuck up higher than the rest, and then the supreme court would slap this down and then they couldn't pressure the companies with costly lawsuits.
