Is it still a crime to do it on a decentralised network where there is no global? Or is it only a crime to do it in the walled garden of some necrophage megalomaniac?

It's a "crime" either way apparently but nostr is still under their radar. I think the difference though is on nostr it is an unenforceable "crime", because when it's big enough there will be just too many people saying whatever the fuck they want
