Technically, the EU does not legislate. They pass directives that each state legislature must "transpose". EU regs set minimum mandated -- meaning more often than not, state laws are even worse and more oppressive. On occasion, an individual state may disagree and find ways to skirt or creatively "interpret" the directive, though that may upset the overlords and put in motion punitive action.

Elected Parliamentarians legislate. Appointed Bureaucrats regulate. Unfortunately, the latter has gotten the better of the former in the EU.
