In addition to being the Dean of the Colleges of Law in Ventura and Santa Barbara (collegesoflaw.edu) I am the co-host of SideBar, a new podcast on Legal Talk Network. (sidebarmedia.org)
I saw a post that asked: why is divestment political but investment is not? And I can’t stop thinking about it.
Michelle Goldberg interviews the authors of How Democracies Die about their new book Tyranny of the Minority. It turns out they didn’t anticipate how quickly the GOP would adopt authoritarian rule. Their path out of authoritarian rule—constitutional reform. We are seeing that battle play out at the state level, reforming the federal constitution is much more challenging. Let’s start with something easier - like Senate rules. End the filibuster. No paywall. image
It’s a sports #journalists saying what political journalists will not. Thanks Jim Trotter. “Legislators used to focus on the greater good and treat compromise as something to be celebrated instead of loathed. Nowadays, however, there must be a winner and loser. Selfishness has replaced selflessness, with the needs of the one outweighing the needs of the many.” #democracy #USpolitics #USpols #media #sports #politics
The architects of the Texas Heartbeat Law (SB8) have now brought a new level of cruelty. Local ordinances that “make it illegal to transport anyone to get an abortion on roads within the city or county limits. The laws allow any private citizen to sue a person or organization they suspect of violating the ordinance.” Notice, once again, that the state is not enforcing the law—private citizens are. #abortion #USpol #USpolitics #law #lawfedi #democracy https://wapo.st/3L6AGWn
In 1991, former Chief Justice Warren Burger called the special interest push to define Second Amendment rights as absolute "a fraud on the American people." SCOTUS has actively participated in that fraud. "If the militia can be well-regulated why can't a 16, 17 or 18 year old?" #guns #shooting #2A #democracy #USpolitics #law #lawfedi #SCOTUS Listen.
It is the 60th anniversary of #MLK’s “I Have a Dream Speech” and it feels like we are farther away from that dream then at the 50th anniversary. @npub1xt3a...n757 places today within historical context and provides a path forward. His book The Third Reconstruction: America’s Struggle for Racial Justice in the 21st Century is a must-read. #blackmastodon #race #equality #reconstruction
Recently, Justice Alito said “I know this is a controversial view, but I’m willing to say it. No provision in the Constitution gives them the authority to regulate the Supreme Court — period.” I wonder if he would accept the same being said about the #SCOTUS’ authority to determine the meaning of the constitution. There is nothing in the constitution that gives SCOTUS the final word on its meaning. Yet, it dictates to the other two branches all the time. The hubris! #law #lawfedi #lawyers
There is no doubt that Mark Meadows or Georgia will appeal the removal decision and it will likely reach #SCOTUS on the shadow docket. Guess who will review it first--Justice Thomas. As we know--he won't recuse himself nor is he required to do so. He could stall the proceedings pending full Court review. Stephen Vladeck explains the shadow docket on an episode of SideBar. #law #lawfedi #lawyers #judiciary #Georgia #indictment
In its report PenAmerica describes “forced outing” bills—laws that require schools to inform parents if a student is presenting differently than the sex assigned at birth. Let’s dive into Alabama’s law. It makes if a Class C felony for school personnel to “withhold information” from a parent about a “minor’s perception that his or her gender or sex is inconsistent with the minor’s sex.” Anyone know what this means? It’s a crime not to. #LGBTQ #trans #education https://legiscan.com/AL/text/SB184/id/2566425
PenAmerica has issued another excellent report on what it calls “educational intimidation bills” that are intended to police teachers and students self-expression, especially around #LGBTQ+ identity. The report does a great job of tying all the attacks on public education together so that the reader can see and understand the cumulative effect. #education #democracy #LGBTQ
Three years later and my blood sill boils when I listen to Trump’s calls to Georgia. And three years later he still sounds desperate and pathetic. And three years later I still cannot believe how many people, especially lawyers(!), who enabled and assisted his delusional efforts to undermine our election. No paywall; you can read through the Georgia timeline & listen to several excerpted calls. #democracy #elections #politics #USpolitics #lawfedi #law #lawyers https://wapo.st/3OxbSIg
