No, i dont think its stealing if you taking ovwrflow water that would anyway flow away. Also, if no on is ever coming out there and using, there is eminent domain which the US was founded on.
Ideally, if you met the owner of the land and cleared with him would be best.

It belongs to the guy who owns these cows. It is ranch property. But he is never out here. The well autofulls the troffs and then overflows.
I think he would be okay with me taking 300 gallons a month when probably 100x that is being spilt back to the earth..
you should talk to the property owner. 99% of the time theyre ok with it and 300 gal/mo is nothing. 3000 gal/mo is barely anything.
i have an identical (opposite) setup with the family who lives downhill from me.
the concern is usually that you can get squatters rights to the water if you're taking it for long enough. and while you might be cool, what if you sell to someone who isn't.
so its best to keep this sort of stuff out in the open.
I'm not going to do that because I know he would say no. I know people who know the guy.

Two levels here.
1. Is it legal?
2. Is it ethical?
The first is easy to answer.
If it's on private property just trespassing is going to be an issue. Best to try to talk to the owner if you can get ahold of them.
The second question is more subjective. It sounds harmless to me personally, but I'd put myself in the land owners shoes. If I found out someone was doing that without asking me I might understand, but I wouldn't be happy.
I see. If you know the guy is unreasonable you're probably better off doing it secretly for as long as possible
I think if you met me in that situation, you would be happy to share.
It's on a road that goes right to my property. It blows my mind that catching water that is flowing onto the ground could be called stealing. Especially given all the factors here.
I only grab overflow and it isn't much at all.
I still don't remember signing that contract that made me subject to other peoples rules. I am a good man and I know it. Good enough for me.

I'm not making any moralistic judgments here, but the issue comes down to property rights.
If you enjoy the benefits of property rights (everyone does whether they realize it or not) then it's best to respect the property rights of others.
Of course there are always gray areas. That's up to you to determine.
Exactly. There is always some fair exchange taking place.
There is my life. I never want to take from anyone. I tend to always give more whenever I can. It feels good.
That's why I am blessed with "free" water
This may be a sign that you feel that you have abundance.
Ironically, trying to give more, the universe balances this and it will come back to you.
The same for those who try to take more from others, will pay in other ways at some point. Duality is everywhere.
