I think the privacy aware x % of people and opensourcehardware device developers might have to settle on a compromise with governments on this. (In order to be allowed to keep encryption/data privacy at all.) Something like: Government accepts that the baseband (closed source) is strictly isolated from the main processing and can not spy. Privacy advocates accept that the baseband will always be running even if the device is off so their location can practically always be tracked.
