Of course. A lightning node operator is a money transmitter. It is taking the law time to catch up to that. But anytime a person or business handles someone elses money, a license is needed.

well it depends if they are running the node themselves or with a third party. I think it's some guy at an agency, but he could be 'part of' the service. In that case, PnP is licensed. It's a valiant effort.
Government not bothered because tax is already include in the final price of goods sold, so they are taking their tax on it. Maybe income tax, but that's up to PnP to handle,
Either way, the LN node op is a money transmitter. When enforcement kicks in, the first thing that will happen is that Lightning will be 100% custodial.
