Buying an iphone is voluntary. They haven't a monopoly on smartphones. We'll lose this case everytime.

I wouldn't be surprised if Apple's lobbyism and consistent citing of security reasons is why it hasn't seen harsher treatment in this case. That the App Store is limiting and only profiting Apple hasn't exactly been a secret for forever now - and yet, they are still left untouched...in the states. I really hope the EU has success; this could, potentially, maybe a ripple effect for other states or countries to sue on the same basis and enforce it respectively. But, as with most things of these days - unless it happens, and actually does happen, it's not real.
