It's in court right now to see if he'll be deported, you don't need to be convicted of a crime or put on criminal trial to be deported as a green card holder.
He's not a citizen. Period.

He's getting due process - which where he comes from, doesn't exist.
You said he's not innocent, which is false unless he has a conviction.
