Think of DEX. They are just contracts that self-regulate interest between maker andctaker producer and customer.

Sure, but... DEx exists only online, so they simply can't go beyond software, IRL there is no software. A smart-contract is as it was programmed to be, a real-life contract could be interpreted, breached and so on.
