41. Does a passport belong to an individual or a government? Contrary to popular belief, passports generally belong to governments, not the individual citizen using the passport. This means passports can and are annulled, revoked, and seized by governments. #dualcitizenshipfaq https://www.malakoutilaw.com/dualcitizenshipfaq

Pro tip: If your citizenship “advisor” or “consultant” is willing to give you consult with you for free, you’re dealing with a salesman, not a consultant, and certainly not an expert. Expert consultants and lawyers in global mobility don’t “chat” with prospective clients for free. Don’t shoot the messenger. #freedomofmovement #globalmobility #mobilitylawyer

Are there any drawbacks unique to citizenship by investment? Yes. First, citizenship by investment tends to be the only category of naturalization in which countries lawfully (i.e. not just at the whim of a dictator) strip an applicant of citizenship for alleged misconduct AFTER obtaining the citizenship. Generally, with other forms of naturalization, once you naturalize, your citizenship is safe besides in very narrow circumstances such as a) fraud in obtaining the citizenship, or b) treason/terrorism. Second, citizenship by investment is under attack by the west. Your visa-free access via citizenship by investment could be cut down, as the EU did with Vanuatu in 2022. Citizenship by investment is still fantastic for those with the means and sometimes the only option for someone wanting second citizenship. But, a client needs to know the risks and downsides. The vast majority of citizenship by investment agents and “consultants” (i.e. salesmen) will never bring up such downsides or even acknowledge they exist. #citizenshipbyinvestment #dualcitizenship

34. Is it possible to get citizenship by investment with a criminal record? It’s said in the mobility industry that one must have a “clean record” to get citizenship by investment. That’s largely true, however the "smaller" the crime and the longer ago it was committed, the more chances a person has getting citizenship by investment. A particular situation and person's criminal record should be screened individually before citizenship by investment is ruled out as a possibility. #americandualcitizenship #dualcitizenship #dualcitizenshipfaq https://www.malakoutilaw.com/dualcitizenshipfaq

The biggest motivators for my American clients to pursue 2nd citizenship are: 1. Desire for Plan B home; 2. Wish to live part time in Europe; 3. General distrust/concern of America’s direction. Very few are actually consistent renunciation of U.S. citizenship in the near future, although some consider the fact that a 2nd citizenship would more easily facilitate renunciation in the future if necessary. #multiplecitizenship #freedomofmovement

“Strategy: Legal Opinion Letter This combination of FBI idHS and court records requested for can be confusing to an adjudicator trying to decide whether an American should be granted or denied citizenship based on a criminal record. Most citizenship and residency adjudicators are not lawyers. To that end, one tool that can be used to explain the arrest, charge, and conviction information in digestible terms is a legal opinion letter written by a lawyer from the jurisdiction of the arrest. Additionally, the legal opinion letter can also serve two other critical roles. First, it can be used to include relevant positive information about the applicant’s history that can help color the adjudicator’s impression of what might otherwise be negative (criminal history) information. Second, it can be used to compare the U.S. conviction to what would be the analogous conviction in the jurisdiction that is evaluating the second citizenship. A comparison of convictions is often required under the domestic law of the foreign country to determine whether an American applicant’s criminal record must result in a denial for his citizenship or residency application.” #fbibackgroundcheck #dualcitizenship #freedomofmovement https://www.malakoutilaw.com/the-basics-of-an-fbi-background-check-identity-history-summary

17. How do dual citizens travel internationally? Dual citizens can travel with either one or both of their passports. However, most countries require their citizens to enter the country only with the passport of that country. For example, if you become a dual American-Grenadian citizen, you would have to enter the United States with your U.S. passport. However, if you’re traveling to France, you can enter with either your U.S. or Grenadian passport. #americandualcitizenship #dualcitizenshipfaq https://www.malakoutilaw.com/dualcitizenshipfaq

10. Do I have to do a lot of paperwork to get dual citizenship? It depends heavily on the type of case. On the low end, we typically see applicants with fairly very “straightforward” cases have to submit eight to ten documents (along with apostilles and translations, if necessary). For most of our applicants, we usually submit at least twelve to fifteen documents. More complex cases can require identifying, gathering, apostilling and translating twenty documents or more. #dualcitizenship https://www.malakoutilaw.com/dualcitizenshipfaq
