🧵 Legal thread of the week: They fired every regulator who said no 👇 [1/7] A senior #CFTC official sent staff a pre-written memo recommending approval of a firm's application. Standard practice: staff write recommendations for commissioners. She wrote her own. She is now general counsel of that same firm. [2/7] Three firms sat at the center of the NYT investigation. #Polymarket, invested in by a firm partly owned by Donald Trump Jr., who also advises it. Cryptocom, exclusive partner of Trump Media & Technology Group. Gemini Titan, founders back American Bitcoin, co-founded by Eric Trump. Each needed CFTC sign-off. Each got it. Staff who objected were placed on leave. [3/7] The enforcement numbers tell the rest. Biden CFTC: 80+ cases involving digital asset firms. Trump's second term so far: 2. Both against individual operators. Zero against prediction-market platforms. Zero against the firms whose applications were fast-tracked. [4/7] The revolving door, documented: Caroline Pham, then-acting Chair, pushed approvals through over staff objections. Now at MoonPay, which holds an exclusive partnership with Polymarket. Brigitte Weyls, senior counsel, wrote Gemini Titan's approval memo herself. Now its general counsel. This isn't a scandal. It's a business model. [5/7] Congress is now moving the #CLARITY Act, a bill that would hand the CFTC sweeping new authority over spot commodity markets. Senate Banking Committee advanced it 15-9 earlier this month. Expanding jurisdiction to an agency this structurally exposed is not oversight reform. It's a larger attack surface for the next political cycle. [6/7] The real lesson isn't about Trump. When regulators control market access, political incentives will always, eventually, control regulators. Permission systems don't fail because of bad actors. They fail because the incentive to capture them is always greater than the incentive to defend them. Bitcoin doesn't petition the CFTC to settle a transaction. That's not a coincidence. [7/7] The CLARITY Act passed the House. The Senate is moving. If it passes with the CFTC in its current state, the question isn't whether the agency gets captured again. 🧵 Legal thread of the week: #CLARITY Act Explained Simply: What It Actually Means for Bitcoin Self-Custody The Senate Banking Committee just advanced a major bill on Bitcoin. 👀 If you hold your own keys, most of it won’t change your daily life. But two specific parts give Bitcoin self-custody real, long-term legal ground it didn’t have before. Here’s exactly what they are. Current status, plain and simple: 👇 The bill cleared the Senate Banking Committee on May 14 with bipartisan support. It is not law yet. It still needs the full Senate, the House, and the President’s signature. If it passes, most rules start 360 days later. ✅ What “Bitcoin as a commodity” actually means: The bill officially treats Bitcoin like a commodity (similar to gold or oil), not like a stock or investment contract. This puts spot Bitcoin trading under the Commodity Futures Trading Commission instead of the SEC. Exchanges get one main regulator with clearer commodity-style rules instead of securities rules. It reduces confusion and overlapping demands on platforms that handle Bitcoin. The Keep Your Coins protection (Section 605): 👇 This part says federal agencies cannot prohibit, restrict, or impair your ability to use a self-hosted wallet to hold your own Bitcoin. It is the first time Congress has written this kind of explicit protection into law. It still allows normal enforcement against money laundering and sanctions, it just stops regulators from going after regular self-custody itself. What happens if a platform fails (Title VII): 🚨 If you keep Bitcoin on an exchange or custodian and that company goes bankrupt, the bill treats your #Bitcoin as customer property. This means your coins should stay separate and return to you, instead of becoming general assets that other creditors can claim. It gives Bitcoin the same basic customer protection that already exists for traditional commodities and securities. ❓ What this could mean for future tools and services: Developers building non-custodial Bitcoin software and protocols get clearer safe harbors, as long as they never take custody of user funds. This survived the committee vote. It may make it easier for more non-custodial wallets, tools, and services to exist without facing heavy licensing or securities burdens. Exact next steps before the CLARITY Act can become law: 👇👀 It must still pass the full Senate (needs 60 votes to overcome a filibuster). Then it goes to reconciliation with the House version. Finally, the President must sign it.
