來說說我對 #死刑 的看法。特別是我想聊聊對於從一位死刑支持者到支持廢除死刑的思維轉換。 我相信有讀過法律的朋友，多數是贊成 #廢除死刑 的。這也就是你會看到，大多數律師都站在廢死的立場。你一定會很疑惑，這是為什麼？ 讀法的人，都會知道法律權力的強大。甚至還延伸出，法律是給懂法律的人玩的，這樣的負面印象。但也正是法律可以剝奪你的財產、生命權，因此使用上才要更加小心。 支持廢除死刑，無非就是希望更謹慎地使用這項權力。別忘了，審判者不是上帝，而是人，立法者也非聖賢，也是人，只要是人，就有錯的可能。從江國慶冤案，到邱和順冤案，你很難確保100%沒有判錯的可能。 或許你會問，那鄭捷呢？罪證確鑿了吧？但鄭捷的基本司法救濟途徑被保障了嗎？並沒有。你或許會說，鄭捷的案件已經三審定讞了，但你不知道的是，還有非常上訴，而鄭捷被剝奪了這個基本的權利，19天後伏法槍決。如果我們號稱民主與人權的國家，不保障嫌犯基本的司法流程，與人治國家有何不同？ 死刑是把殺人的權力交給國家、交給政府，但如果真的要以牙還牙，以眼還眼，這把槍交到你手裡時，你會願意去執行嗎？沒有，因為大家只想逃避，逃避面對開槍的責任，只想讓法警去背負。就算是被害者家屬也是如此。更遑論，「以牙還牙，以眼還眼」的概念，是建立在西元前的《漢摩拉比法典》裡，人類文明難道停留在了3000年、4000年前嗎？更別提死刑的存在，根本沒有降低犯罪率。 那麼國家該如何幫助受害者呢？心裡諮商與輔導的介入就變得格外重要。原諒是件很難的事，原諒了對方，其實也是原諒了自己。仇恨，不會讓死者復活，報復，不會讓你脫離輪迴。如何撫平傷痛與傷痕，是國家可以做的。別忘了，所有的暴力及殺戮一定有所原因，包括經濟問題、錯誤的教育……等，都是導致遺憾發生的原因，而政府更應該著力在這些根源上，而非用死刑來簡化與逃避問題。
