We now know that custody of "funds" is not required to be guilty of operating an unlicensed money transmitting business under 18 U.S.C. § 1960 (b)(1)(C).
Accordingly, bitcoin miners, Lightning service providers, and CoinJoin coordinators should perhaps refrain from demonstrating any awareness that their business might touch any funds associated with unlawful activity.
Don't talk about it. Don't write about it. Don't hint at it on t-shirts. Liability now hinges on knowledge and intent, not custody.

Yesterday, Samourai filed its reply in support of its motion to dismiss the indictment.
Samourai emphasizes that FinCEN guidance explicitly permits CoinJoin coordinators, which do not take custody of user's funds. Samourai further argues that it did not violate section 1960 because it did not "transfer[]" funds since it never took custody of users' bitcoin.

In Count Two, the DOJ originally alleged that Samourai conspired to operate an unlicensed money transmitting business in violation of 18 U.S.C. § 1960(b)(1)(B) and (C). The DOJ recently withdrew subsection (B) in a superseding indictment, leaving only subsection (C) remaining.
Thus, liability for Count Two now hinges on whether Samourai was a (1) "money transmitting business" that (2) "involve[d] the transportation or transmission of funds" (3) that Samourai knew came from or were intended for an unlawful purpose.
