This is from the proposed final jury instructions in the DOJ's case against Roman Sterlingov. According to the State (and the court), bitcoin is "money" in the context of money transmission licensing laws. Are unregistered miners and node operators also in violation? At what point is a First Amendment defense appropriate? Bitcoin is just 0s and 1s. We're merely recording addresses and sharing signatures. How can the State require a license simply for broadcasting this data? Also, I wish I could share the entire file with you, but Dropbox doxxes my real name in any link I share.
